In accordance with the provisions of (i) the Federal Act on the Protection of Personal Data Held by Individuals (the”LFPD”); (ii) the Regulations of the LFPD; and (iii) the Privacy Notice Guidelines published in the Official Gazette of the Federation, “Mexican Solara Constellation”, S.A. de C.V., (“Solara”), as Responsible for the processing of the personal data it collects, makes available to its customers and users of digital platforms (each referred to as”Titular”) this Privacy Notice (the”Notice”).

Solara requires certain personal data to be processed in order to be able to provide its online services. Solara can obtain this data from any of the following sources: (i) through your application and/or your website (s) and landing page (s) (indistinctly, app.solara.energy) and/or through any link, microsite or access directly related to them (the”Sitio”); and/or (ii) through messages and other electronic communications.

Solara reserves the right to change the content of this Notice at any time. Any changes to the Notice will be notified to the Owner through a general notification on the Site. The corresponding amendment will take effect as of the day following its publication.

1. Solara's Identity and Domicile

Solara is a commercial corporation duly constituted in accordance with Mexican legislation, as recorded in public decree 78,978, dated November 25, 2021, granted in the faith of Mr. Ignacio Soto Sobreyra y Silva, Notary Public No. 13 of Mexico City.

Solara's address is located at 255 Amsterdam Street, interior 406 Colonia Hipódromo Condesa, Cuauhtémoc Mayor's Office C.P. 06100, Mexico City.

2. Personal Data subject to treatment

The Data Controller that Solara may process are the following: name, telephone number, email and address.

The Owner acknowledges that the above-mentioned personal data may be stored using cloud storage. Where appropriate, Solara will ensure that the corresponding supplier complies with the provisions of the LFPD Regulations.

The Owner acknowledges that the Site contains links or embeds that redirect or communicate with third party electronic payment processors and/or similar services, in which case your data will be sent to these third parties in their capacity as processors. At no time will Solara collect data from the Owner that may be considered sensitive, in accordance with the LFPD or its Regulations.

3. Purposes of the treatment

The personal data processed by Solara will be used to carry out the following purposes:

  1. Primary Purposes:
  1. Identify the Owner;
  2. Generate financing quotes for solar systems;
  3. Perform credit evaluations of prospectuses; and
  4. Request Credit Information from Public Institutions.

  1. Secondary Purposes:
  1. Use personal data for marketing, advertising or commercial prospecting purposes.

The Owner may express his refusal to process his data for secondary purposes, by sending an email to that effect to Pablo Rión in charge of the Site, which must contain his contact information and any other information that allows him to respond to said report, refraining from providing confidential information that he does not own or that he does not have authorization to transfer.

4. Consent of the Owner

The Owner states that:

  1. This Notice has been provided to you by Solara;
  1. You have read, understood and agreed to the terms set out in this Notice, so you grant your consent regarding the processing of your personal data;
  1. Use of the Site constitutes tacit confirmations of your consent to the provisions of this Notice. The Owner must refrain from continuing to use the Site if he does not consent to the provisions set out in this Notice.

Solara assumes that the information provided by the Owner belongs to the latter. If this is not the case, the Owner must immediately inform Solara of this circumstance, by sending an email to pablorion@solara.energy which must contain your contact information and any other information that allows you to respond to said report, refraining from providing additional information that you do not own or that you are not authorized to transfer.

The Data Controller may revoke the above-mentioned consent at any time. To revoke the consent provided, the Owner must communicate this circumstance to Solara by means of an email sent to pablorion@solara.energy indicating the reasons that motivate you to communicate the revocation, as well as the information that allows Solara to respond to and follow up on said revocation.

If the Data Controller wishes to limit the use or disclosure of any of their personal data, they may at any time send a statement of such limitation by sending an email to Pablo Rión at the email address pablorion@solara.energy which will include the personal data whose processing you want to limit, the reasons for which you want to limit them, as well as the information that allows Solara to follow up on said request. If the Owner's request is appropriate, Solara will register the Owner on the exclusion list that it will have drawn up for this purpose.

5. Rights of Access, Rectification, Cancellation and Opposition (“ARCO”)

The Data Controllers have the right to: (i) know what personal data is processed by Solara and the purposes of its processing (right to access); (ii) request the correction of their personal data if they are out of date, inaccurate or incomplete (right to rectification); (iii) to have their personal data deleted from Solara's records or databases when they consider that they are not being used properly (right to cancel); and (iv) to object to the use of their personal data for specific purposes (right to object) (together, the “ARCO” rights)

ARCO rights can be exercised at any time by sending an email to Pablo Rión at pablorion@solara.energy. The request for any of the ARCO rights must be accompanied by the following:

The name of the owner and/or their address or email address, so that Solara can communicate the response to your request;

The documents that prove the identity or, where appropriate, the legal representation of the owner;

The clear and precise description of the personal data with respect to which one seeks to exercise any of the ARCO rights;

The reasons that support or justify the exercise of the corresponding ARCO right;

The format or medium in which you want Solara to respond to your request, when applicable;

Any other element or document that facilitates the follow-up to the Owner's request.

5. Use of cookies, web beacons or similar or similar technologies

Solara will be able to use Cookies, Web beacons and or other technologies to monitor your behavior as an internet user, in order to provide you with a better service and user experience when browsing the Site, as well as offering you new products based on your preference. The personal data that Solara obtains from these tracking technologies are in particular the following: browsing schedule, browsing time, sections consulted and previously accessed Internet pages, IP address of origin, browser used, operating system, and it is possible to monitor your behavior as a user of Internet services.
